Guide to Duty-Free Vehicle Import for Persons with Disabilities in Kenya

Importing a vehicle duty-free as a person with a disability in Kenya is a process designed to facilitate mobility and inclusivity. Checklist for Approval of Exemptions

To successfully import a vehicle duty-free, you will need to gather the following documents and follow these steps:

1. Application Letter

– Write an application letter addressed to the Commissioner of Customs & Border Control requesting an exemption.

2. Medical Certificate
– Obtain an original medical certificate from a registered doctor.
– Attach a certified copy (certified by a Commissioner of Oaths) to your application.
– Present the original certificate during your physical interview.

3. Letter of Recommendation
– Secure an original letter of recommendation from:
– The Association for the Physically Disabled of Kenya, or
– The National Council of Persons with Disabilities.

4. Driving License
– Provide a copy of your driving license with a class ‘H’ endorsement (currently class F).
– If you have visual, mental, or hearing impairment, you may nominate a driver:
– Attach a driver nomination letter.
– Include the nominated driver’s valid driving license and a copy of their ID.
– Ensure the driver swears an affidavit to confirm their nomination.

5. Bill of Lading 
– Submit the bill of lading for the vehicle, addressed to you as the applicant. We provide this on shipment,

– Include the invoice or proforma invoice for the vehicle, addressed to you.

7. Tax Certificates
– Provide a Tax Compliance Certificate.
– Include an Income Tax Exemption Certificate.

8. Proof of Payment
– Attach cash remittance/transfer slips used to pay for the vehicle as proof that the payment was made by you.

9. Bank Statement
– Submit your bank statement for the last six months, showing the transaction for the vehicle payment.

10. National ID
– Provide a copy of your national ID card.

11. NCPWD ID Card
– Include a copy of your NCPWD (National Council for Persons with Disabilities) ID card.

12. Test Drive
– Conduct a test drive in the presence of a customs officer at the point of entry, such as Mombasa or JKIA.

13. Replacement Policy
– You are allowed to replace the motor vehicle after four years. Ensure you provide proof of disposal of the originally imported motor vehicle in accordance with Section 119 of The East African Community Customs Management Act, 2004.

Approval Authority
The Chief Manager RE will handle the final approval process for your duty-free vehicle importation.
